Users may include developer and builder, property agents, property owners, buyers, renters, investors, or any other party interested in real estate transactions.  

3.2 “ Developer ” means : an individual or a company engaged in the construction business in real estate or involved in land development. Developers on Dekagon Prrop Search are entities responsible for building or developing properties for sale or rent. They may list their projects or properties on the platform for potential buyers or renters to explore.  

3.3 “ Agent (Prop Navigator) "also referred to as a "Prop Navigator" on Dekagon Prrop Search, is a broker or a real estate professional who lists properties on behalf of their clients. Agents act as intermediaries between property owners (sellers or landlords) and potential buyers or renters. They assist clients in marketing their properties, facilitating negotiations, and closing deals. Agents may include individuals or companies specializing in real estate brokerage services hold RERA number and operates under RERA compliance .  

3.4 Metadata Content” means the metadata provided by user to Dekagon Prrop Search    including, but not limited to any text, data, images, and other content provided and/or authored by user 

3.5 “Metadata” means a set of data that provides information that describes and explains data. It provides context with details such as the source, type, owner and relationships to other data sets.

3.6 Updates” means updates, refreshes, corrections and/or other modifications.  

4 . User Registration  

4 .1. Users must be of legal age and capacity to enter into agreements as per the laws of their jurisdiction to register an account with Dekagon Prrop Search.  

4 .2. Users agree to provide accurate, current, and complete information during the registration process and to update such information promptly if there are any changes.  

4 .3. Users are solely responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

5.4. Dekagon Prrop Search reserves the right to request proof of authorization from users listing properties on behalf of others at any time. Failure to provide adequate proof may result in the removal of the property listing and suspension or termination of the user's account.  

5.5. In case of a dispute regarding property ownership or authorization, the burden of proof rests with the user who listed the property. Users must be able to provide sufficient evidence of their authorization to list the property on Dekagon Prrop Search upon request.  

5.6. Users acknowledge and agree that Dekagon Prrop Search may take appropriate action, including removing property listings and suspending or terminating user accounts, in cases where there is evidence of unauthorized listing or violation of these   

  6 . Value-Added Services  

6.1. Dekagon Prrop Search offers a range of value-added services to enhance the user experience and provide additional support in the property search and transaction process.  

6.2. These value-added services may include but are not limited to:  

  • Home loan consultancy and processing assistance  
  • Interior consultancy and implementation services  
  • Vastu consultancy  
  • Numerology consultancy  
  • Legal consultancy  
  • Property insurance consultancy  
  • Financial consultancy  
  • Site visit arrangement in selected cases  

6.3. Users availing themselves of value-added services acknowledge that:  

  • Some services may be provided by third-party service providers, and Dekagon Prrop Search acts solely as a facilitator or intermediary.  
  • Charges may apply for certain services or products, and users may need to pay separately for these charges.  
  • Dekagon Prrop Search is not responsible for the quality, accuracy, or outcomes of services provided by third-party service providers, and users should exercise due diligence before availing themselves of any services or products.

In no event shall Dekagon Prrop Search       be liable    with respect to any subject matter of the terms of use or terms and conditions related thereto under any theory of liability including but not limited to contract, tort (including negligence) or otherwise for any direct, indirect, incidental, special, consequential, punitive, exemplary or other damages arising out of this agreement or the use of or inability to use the    service, including, but not limited to, loss of revenues, loss of profits, loss or inaccuracy or corruption of data or cost of procurement of substitute goods, service or technology. This limitation shall apply even if Dekagon Prrop Search was or should have been aware or advised of the possibility of such damages and notwithstanding any failure of essential purpose of any limited remedy stated herein. 

10.Indemnification  

10.1 Users will indemnify, defend, and hold Dekagon Prrop Search harmless from any third party lawsuit or proceeding brought against Dekagon Prrop Search based upon a claim that would constitute a breach of any warranty, representation or covenant made by the user under the Terms of Use. Users indemnification will include (1) all attorneys' fees and costs associated with the defense of such a claim, (2) all damages and costs finally awarded, and (3) the full cost of any settlement entered into by User. Dekagon Prrop Search shall (1) notify the users of any such claim, (2) provide users with reasonable information, assistance and cooperation in defending the lawsuit or proceeding (to the extent requested by User), and (3) give users full control and sole authority over the defense and settlement of such claim. Users will not enter into any settlement or compromise of any such claim without Dekagon Prrop Search's prior consent, which shall not be unreasonably withheld.

11 . Governing Law and Dispute Resolution  

11.1. Any dispute arising out of or relating to these T&C shall be  referred to a Sole Arbitrator to be appointed in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The language, documents and pleadings as also the arbitration proceedings shall be English. The proceedings shall be conducted in Pune, Maharshtra, India only. 

11.2  Subject to the preceding paragraph, the courts in  Pune, Maharashtra shall have exclusive jurisdiction over any dispute, differences or claims arising out of th ese T&Cs .

  • Instead of brokerage fees, Dekagon Prrop Search operates on a listing fee basis.  
  • Users are required to pay a listing fee based on the pricing listed for their property on the platform.  
  1. Separate Services from Parent Company:  
  • While Dekagon Prrop Search focuses on providing a user-friendly platform for property search and listings, its parent company, Tejraj Grroup, offers separate marketing and sales services.  
  • Users can engage in separate discussions and proposals with Tejraj Grroup to avail themselves of these services, which are distinct from the operations of Dekagon Prrop Search.
